Chasing Ghosts
So I get an email from a client I’m doing some work for. Along the easterly boundary of one of their properties it shows a tail of ownership crossing into a neighbor on the county GIS. I look at their deed (a court ordered action) and let them know that the property doesn’t cross the fence like the county shows.
But of course I begin to wonder, what the heck is going on with that GIS!!
My office had surveyed that line in 1991, with a date of 11-1991. So I look up the creation deed from May of 1991 and sure enough there is the tail hanging out kinda like the GIS shows. But the survey doesn’t show that. I wasn’t involved with this survey, there was a bit over 2000 acres that got split into 3 parcels and attached to three adjoining ranches.
So I go to the file, which is scanned into our data base; 227 pages of it. And we had done what amounts to a clean up survey and wrote three deeds. But, no record of what happened after the survey. I’m wondering if it all got done, the surveyor who did it isn’t around this week, so down to the courthouse. Sure enough there are the transactions. The original deeds for the three parcels are deeded to an attorney and she re-issues the three 660+ acre tracts to the three ranches based on descriptions from the survey, thus “cleaning up” some issues including that tail. This is 1992.
So the big question is how in the world does the GIS show that tail? They have all three deeds, they have a filed Record of Survey and a chain of title. Even the old paper tax maps which I still have from the 1990’s show it correctly. Very strange that it could get re-inserted this late in the game.
AND: I’m doing a split for a family estate. One of the family members insists that he has a Warranty Deed from the county for a vacated street (he’s on the phone telling me he’s looking at it). The county issuing something like that would be a huge mistake, especially since he didn’t own on either side of the street. I look everywhere in the records. I hate looking for something that doesn’t exist!!!!!
