T. Nelson – SAM, LLCU.S. v. Citko
I seem to remember seeing a copy of a nasty letter the U.S. Attorney sent to the Forest Service surveyors after she had her a$$ handed to her in court telling them to make sure they understand how to do their job correctly before they send her into court again.
tl;dr version
Forest Service surveyors spent hundreds of hours to decide that the stone pile wasn’t the corner in question and the corner was lost, repeated field searches, old record research, even forensic search for discolored dirt that might indicate where the bearing trees once stood.
Citko brought in an old timer that said in 1927 he was deer hunting there with his brother, saw the stone pile and thought a couple of tamarack trees looked odd. Walked over to them and the one to the north had a “24” carved in it and the one to the south had “25”. Seemed odd, so it stuck in his mind all those years.
Case closed
I presented to lawyers. I included the citations. One of the lawyers thanked me for that…he said usually presenters don’t include citations.

Meaning aggressively passive.
I don’t see any lawyers but they usually sit in the rear reading something (most likely billable)
There ain’t no donuts in photo.
Triple negative? 🙂@makerofmaps
Those don’t look like any chairs they have at Surveyors seminars I’ve ever been to. Must be there because of the lawyers insistence. 😉
